2. Legal background

The Civil Szemle Foundation and DUE Press base their data management information on the following legal background:

- REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Regulation (EC) No 95/46/EC (GDPR).

- Act CXII of 2011 on the Right to Informational Self-Determination and Freedom of Information (Infotv.)

-Act V of 2013 on the Civil Code (Civil Code).

-Act CXXX of 2016 on the Code of Civil Procedure (Pp.).

-Act C of 2000 on Accounting (Accounting Act).

-Act CVIII of 2001 on certain aspects of electronic commerce services and information society services (Eker. tv.)

-Act XLVIII of 2008 on the Basic Conditions and Certain Restrictions of Commercial Advertising Activities (Act XLVIII of 2008). Data processing is carried out in compliance with the above laws, taking into account the principles of lawfulness.

The Civil Szemle Foundation and DUE Press process data lawfully and fairly and in a transparent manner for the data subject. Civil Szemle Foundation and DUE Press will not use or may not use the personal data provided for purposes other than those described in this information notice. The Civil Szemle Foundation and DUE Press will only process the data provided by the data subject on the basis of his/her voluntary consent or otherwise lawfully made known to it, and will not disclose them to third parties under any circumstances, except in the cases provided for by the legislation in force. The transfer of personal data may only take place in accordance with the relevant legal provisions to this effect or with the consent of the data subject, to the extent specified therein.

3. Purpose of processing

The Civil Szemle Foundation and DUE Press process personal data to publish the journal Civil Szemle, to distribute tt o subscribers and to operate its website.

4. Categories of personal data and duration of processing

The data of subscribers, authors, partners involved in the publication of the journal are possessed and processed by the Civil Szemle Foundation (1137 Budapest Pozsonyi út 14. II/9. civilszemle@gmail.com, www.civilszemle.hu) and DUE Press (Dunaújváros, Táncsics M. u. 1/A. duepress@uniduna.hu).

The Civil Szemle Foundation and DUE Press process only personal data that are indispensable for the purpose of the processing and are suitable for achieving that purpose, and process personal data only to the extent and for the duration strictly necessary for the purpose of the processing. The Civil Szemle Foundation and DUE Press shall ensure the confidentiality of the personal data processed and their protection from unauthorized persons, in compliance with the provisions of Article 32 of the GDPR, as follows:

  • Ensuring the continued confidentiality, integrity, availability and resilience of the systems and services used to process personal data.
  • In the event of a physical or technical incident, ensure the ability to restore access to and availability of personal data in a timely manner.
  • It shall regularly test and evaluate the effectiveness of the technical and organisational measures taken to ensure the security of data processing.
  • It shall ensure that natural persons acting under its authority and having access to personal data are allowed to process those data only in accordance with the instructions of the controllers, unless they are required to do otherwise by Union or Member State law. Data controllers shall only grant access to natural persons if they have read, acknowledge and accept in writing this privacy notice.

4.1. Processing of data relating to authors

Manuscripts may be freely submitted to Civil Review (Civil Szemle) for publication. Submission of manuscripts is subject to prior registration at www.civilszemle.hu.

Registration requires: - name (first and last name), - country, - email address, - username, - password. In case of submitting a manuscript to the Civil Szemle Foundation for publication purposes, the registration includes a written declaration of consent to the processing of personal data and to the publication of such data. The author's personal data will then be made public via the Internet if his/her publication is accepted by the editorial staff. The archived issues of the journal are available free of charge at www.civilszemle.hu, and therefore the personal data of the authors provided in the published publications will be made public. In addition, the authors' data of published manuscripts will be provided to accepted providers in the scientific community, which will index and share the scientific publications. When registering, the author gives written consent to the transfer of data.   

The legal basis for the processing of the data is the voluntary consent of the author pursuant to Article 6(1)(a) of the Regulation.

Duration of processing: authors' data will be kept in the journal archives indefinitely. The author has the right to withdraw his/her consent at any time. Withdrawal of consent shall not affect the lawfulness of the processing based on consent prior to its withdrawal. Authors may withdraw their consent by sending an e-mail to the e-mail address of the Data Controller 1.

4.2. Processing of data relating to subscribers

The latest content of the Civil Review (Civil Szemle) journal, published by the Civil Review (Civil Szemle) Foundation and DUE Press, is available on subscription, which requires the processing of subscribers' personal data for the following two purposes.

Subscription requires registration at www.civilszemle.hu. To register, you must provide: - name (first and last name), - country, - billing address, - email address, - username, - password.

Legal basis for data processing: subscription as a contractual relationship pursuant to Article 6(1)(b) of the Regulation. The purpose of data processing is to enable the sale of the Civil Review (Civil Szemle), including the registration of subscribers and the invoicing of subscription fees to them.

Duration of data processing. The subscriber has the right to withdraw his/her consent at any time. Withdrawal of consent does not affect the lawfulness of the processing based on consent prior to its withdrawal. If the subscriber withdraws his/her consent, the services related to the subscription would also cease. The withdrawal of consent may be initiated by the subscriber by sending an e-mail to the e-mail address of the Data Controller 1.

4.3. Data contained in the profile created during registration

The registration is carried out on www.civilszemle.hu and the data are entered voluntarily. During registration, the following data may be entered in the profile of the registered author/subscriber: name (first and last name), - country, - email address, - username, - password, - telephone number, - postal address, - biographical data. No automated decision making or profiling will take place during registration.

Legal basis and purpose of data processing

Legal basis for processing: the author's voluntary consent pursuant to Article 6(1)(a) of the Regulation.

Duration of processing:

Subscriber data will be kept by data controllers for 8 years as required by the Accounting Act. The subscriber has the right to withdraw his/her consent at any time. Withdrawal of consent does not affect the lawfulness of the processing based on consent prior to its withdrawal. If the subscriber withdraws his/her consent, the services related to the subscription would also cease. The withdrawal of consent may be initiated by the subscriber by sending an e-mail to the e-mail address of the Data Controller 1.

Authors' data will be kept in the journal archives indefinitely. The author has the right to withdraw his/her consent at any time. The withdrawal of consent does not affect the lawfulness of the processing based on consent prior to its withdrawal. The author may withdraw consent by sending an e-mail to the e-mail address of the Data Controller 1.

5. Rights of the data subject with regard to data processing

The data subject may request information on the processing of his/her personal data, request access to, rectification, modification, erasure or restriction or deletion of personal data concerning him/her by submitting a written request to the controller at the following address: civilszemle@gmail.com. At the request of the data subject, the controller shall provide information about the data it processes, the purposes, legal basis and duration of the processing, the name, address (registered office) and activities of the data processor in relation to the processing, and who is receiving or has received the data and for what purposes. The controller shall provide the information in writing within the shortest possible time from the date of the request, but not later than 25 days.

The controller shall erase personal data if the processing is unlawful, the data subject requests it, the purpose of the processing has ceased, the statutory time limit for storing the data has expired, or the erasure of the data has been ordered by law, an EU act, the Authority or a court. In the above cases, the controller shall take reasonable steps, including technical measures, taking into account the available technology and the cost of implementation, to inform the controllers that process the data that the data subject has requested the deletion of the links to or copies of the personal data in question.

If the data subject does not agree with the information or the decision given on his or her request or if the controller does not make a statement within the time limit, he or she may take legal action. Further remedies and complaints may be lodged with the National Authority for Data Protection and Freedom of Information:
